BubbleCam is a new camera software installed on smartphones that provides registered users with novel and easy photo taking and communication services.The unique experience provided by the BubbleCam includes but is not limited to the real-time processing of video and pictures based on mobile phones.BubbleCam gives a detailed account for the problem and privacy policy which appear in the process of using the application ,through this agreement and other agreements and rules related to BubbleCam (including but not limited to "BubbleCame– Privacy Policy").
In order to provide you with better services, please be sure to carefully read and fully understand the entire content of the "BubbleCam - Terms of Service (hereinafter referred to as "this Agreement") before you start using BubbleCam. Once you start using BubbleCam, you are deemed to have fully understood this Agreement and agree to be bound by this Agreement and other agreements and rules related to BubbleCam (including but not limited to BubbleCam - Privacy Policy) as a party to this Agreement.
1. User Eligibility
1.1 We allow users who are 9 years of age or older. If you are between the ages of 9 and 18, please carefully review and fully understand this Agreement with the company of your legal guardian, and use BubbleCam with the consent of your parents or other guardians.
1.2 We do not restrict other conditions of users, but when you use our services, you also represent that you will comply with the laws and regulations of the countries and regions where you are located. If your behavior violates local laws and regulations or social customs, you will independently bear corresponding responsibilities (including but not limited to legal liability).
2. About BubbleCam and Services
2.1 BubbleCam and its related services refer to a new type of camera software installed on smartphones through a legally owned and operated by us and its affiliates named "BubbleCam", which can provide users with novel and easy photography services.
2.2 When you use the software and related services, you can obtain the BubbleCam client application from App Store. If you did not obtain this software from App Store, we cannot guarantee that the unofficial version of BubbleCam will work properly, as a result ,we are not reposible for the losses you suffer.
2.3 We may develop different application software versions for different terminal devices, and you should obtain, download and install the appropriate version according to the actual device condition.
2.4 You can use BubbleCam and its developed services or update different versions according to your own needs, if you no longer need to use BubbleCam and its services, you can uninstall it yourself.
2.5 In order to better improve users’ experience and services, we will provide software updates or changes (including but not limited to software modifications, upgrades, function enhancements, development of new services, software replacement, etc.) from time to time.In order to ensure the security of BubbleCam and its related services and improve services to users, after the software and related services are updated or part of the service content is updated, where possible, we will prompt users in ways including but not limited to system prompts, announcements, site messages, etc., and users have the right to choose to accept the updated version or service, if the user does not accept, some functions will be limited or cannot continue to be used.
2.6 Unless authorized in advance by us, you shall not make unauthorized access to or use of BubbleCam and its related services in any form, including but not limited to adaptation, copying, transmission, vertical search, mirroring or trading.
2.7 You understand that your use of BubbleCam and its related services requires your own preparation of terminal equipment (such as mobile phones, etc.) related to the software and related services, and once you open BubbleCam in your terminal equipment, it is deemed that you use BubbleCam and its services. In order to fully use all functions of BubbleCam, you may need to trun on your data or WiFi , and you understand that you will afford the required costs (such as data fees, Internet fees, etc.).
2.8 We grant you a personal, non-transferable, non-exclusive, non-commercial legal right to use BubbleCam and its services. All other rights not expressly authorized in this Agreement shall remain reserved by us, and your exercise of such rights shall be subject to our separate written permission, and our failure to exercise any of the foregoing rights shall not constitute a waiver of such rights.
3. Prohibited Content
3.1 Users shall not use BubbleCam accounts or this service to produce, upload, copy, publish, or disseminate the following content that interferes with the normal operation of BubbleCam and infringes the legitimate rights and interests of other users or third parties:
(1) Any content about racial hatred;
(2) Any abusive, intimidating or threatening content;
(3) Any content including harassing, spamming, malicious information, and deceptive information;
(4) Any content involving the privacy, personal information or data of others;
(5) Any content infringing on the legal rights of others, such as reputation rights, portrait rights, intellectual property rights, and trade secrets;
(6) Any content that contains other information that interferes with the normal operation of this service and infringes the legitimate rights and interests of other users or third parties.
4. Rights of Users’ Accounts
4.1 You can register a BubbleCamaccount as your credentials to use BubbleCam as a registered user.You understand and promise that the account you set up shall not violate the laws and regulations of the country where you are located and our relevant rules.You shall abide by relevant laws and regulations when you register for an account and use BubbleCam, and shall not carry out any behavior that infringes on national interests, harms the legitimate rights and interests of other citizens, and harms social morality.
4.2 The user shall abide by the terms of this agreement, use the service correctly and appropriately, and if the user violates any of the terms of this agreement, we have the right to interrupt or terminate the service to the breached user's BubbleCam account in accordance with the agreement after notifying the user.
5. Protection of Personal Information
5.1 We work with you to protect your personal information, and protecting users' personal information is one of our basic principles. While using BubbleCam, you may need to provide your personal information so that we can provide you with better service and corresponding technical support.You understand and agree that we have the right to access, use, store and share your personal information in compliance with laws and regulations, this Agreement and the BubbleCam– Privacy Policy.
5.2 We will use encryption technology, anonymization and other technical measures matching the BubbleCam and other security measures to protect your personal information, prevent your information from being used improperly or being accessed or leaked without authorization, and establish a sound management system for the aforementioned purposes.
5.3 In the process of using BubbleCam, we promise not to collect or use important information such as your various bank cards, third-party payment accounts and corresponding passwords without your explicit authorization and consent. You understand and agree that you shall bear the disclosure of the aforementioned important information due to your own reasons and any losses that may be caused thereby.
5.4 Without your prior express authorization and consent, we will not share your personal information with any third party other than us and its affiliates, except in the following circumstances:
(1)You share it with third parties yourself
(2) Disclosure or provision is necessary in accordance with the requirements of applicable laws and regulations, mandatory administrative and judicial requirements, or is directly related to criminal investigation, prosecution, trial and enforcement of judgments.Under the premise of complying with laws and regulations, when we receive the aforementioned request for disclosure of information, we will require the other party to issue corresponding legal documents, such as summons or investigation letters.We will carefully review all requests to ensure that they have a lawful basis and are limited to data that the executive and judicial authorities have a legitimate right to obtain for specific investigative purposes;
(3)To the extent permitted by laws and regulations, in order to maintain the life, property and other major legitimate rights and interests of other users, us and its affiliates, or necessary for the safe and stable operation of "BubbleCam" and its related services, such as finding, preventing, dealing with illegal activities such as fraud and reducing credit risks (excluding disclosure or provision of personal information for profit purposes in violation of the commitments made in the "BubbleCam– Privacy Policy");
5.5 If BubbleCam contains links to information provided by third parties or other services (including websites), you acknowledge and understand that the third party operating such services may ask you to provide personal information.We especially remind you that you need to carefully read the user agreement, privacy policy and other relevant terms of such third parties, properly protect your personal information, and only provide it to such third parties when necessary. This Agreement (and other agreements and rules related to BubbleCam, including but not limited to BubbleCam– Privacy Policy) does not apply to the services provided by any third party, and we do not assume any legal responsibility for any possible consequences arising from the use of personal information provided by you by third parties.

6. Legal Liability
6.1 If we find or receive reports or complaints from others that the user violates this agreement, we have the right to review and delete the content of the report and complaint, including but not limited to user information and chat records, at any time without notice, and impose penalties including but not limited to warnings, account bans, device bans, and function bans on the violating accounts depending on the seriousness of the circumstances, and notify the user of the handling results.
6.2 Users who have been banned for violating this Agreement may appeal to the BubbleCamService@outlook.com email from the BubbleCam team. We will review the appeal and decide in our sole discretion whether to change the sanction.
6.3 You understand and agree that we have the right to punish violations of relevant laws and regulations or the provisions of this Agreement based on reasonable judgment, and take appropriate legal action against any user who violates laws and regulations.
6.4 You understand and agree that you shall fully compensate us and cooperate with us, associate with us, and protect us from damages for any claims, demands or losses claimed by any third party caused or incurred due to the user's violation of this Agreement.
6.5 We respect and protect the legitimate rights and interests of legal persons and citizens, such as intellectual property rights, reputation rights, name rights, and privacy rights.You warrant that when using the information produced, copied, published and disseminated by BubbleCam and related services offered by BubbleCam, you will not infringe the intellectual property rights, reputation rights, name rights, privacy rights and other rights and legitimate rights and interests of any third party.You shall bear all legal responsibilities for all claims made by third parties.If we and its affiliates and control of our losses (including economic, goodwill, etc.) suffered by us due to your infringement, you should also fully compensate us and its affiliates and control all losses suffered by us.
7. Intellectual Property
7.1 The intellectual property rights of the content (including but not limited to software, technology, programs, web pages, text, pictures, images, audio, video, charts, layout, electronic documents, etc.) provided by us in the BubbleCam and related services belong to us.The copyrights, patents and other intellectual property rights of the software on which we provide this service belong to us.Without our permission, no one shall use (including but not limited to monitoring, copying, disseminating, displaying, mirroring, uploading, downloading the content in the bubble camera software and related services through any robot, spider or other program or device).
7.2 We provide technical support for the development and operation of BubbleCam, and have full rights to all data and information generated during the development and operation of BubbleCam and its related services.
7.3 Please do not use any of our trademarks, service marks, trade names, domain names, website names or other distinctive brand features (hereinafter collectively referred to as "Logos") under any circumstances. Without our prior written consent, you shall not display, use or apply for trademark registration, domain name registration, etc. in the aforementioned marks of these Terms alone or in combination, nor shall you express or imply to others the right to display, use, or otherwise have the right to deal with such marks.If you use our above-mentioned trademarks, logos, etc. in violation of this agreement and cause losses to us or others, you shall bear all legal responsibilities.
8. Other Terms
8.1 The relevant terms in this agreement will continue to be improved, and continuously improved and adjusted during the process of software testing and external release.We will post the improved terms in an appropriate manner and actively notify you to review them.Once the aforesaid and improved terms are officially released, they will be an integral part of this agreement and have the same legal effect as this agreement.If you continue to use BubbleCam after this Agreement is perfected, you are deemed to acknowledge and accept the modified terms of the Agreement.If you disagree with the modified terms, please stop using BubbleCam immediately.
8.2 You understand and agree that BubbleCam and its related services provided by us are provided in accordance with the current technology and conditions.We will do our best to provide you with the services and ensure the continuity and security of the services.You understand that we cannot foresee and prevent technical and other risks at any time, including but not limited to force majeure, viruses, Trojan horses, hacker attacks, system instability, third-party service defects and other security problems that may cause service interruption, data loss and other losses and risks.
8.3 You understand and agree that we have the right to modify, interrupt, suspend or terminate BubbleCam and its related services after the announcement notice for the overall operation of the service, without being responsible or liable to the user.
8.4 The headings in this Agreement are for convenience and reading only and shall not affect the meaning or interpretation of any provision of this Agreement.
8.5 If part of this Agreement is invalid or unenforceable for any reason, the remainder shall remain in effect. To the extent permitted by laws and regulations, all rights of interpretation and modification of this agreement belong to us.
